BITREFILL's Product Review Policy
Product review ("Review") is an integral part of the customer experience at Bitrefill. Customers use Reviews to learn more about our products, assess whether our products fit their needs, and make an informed purchase decision. Reviews also help us understand our customers' sentiment about our products, what features or aspects of our product customers like, and what areas need improvements. For Reviews to continue to benefit both customers and Bitrefill, Reviews must remain a true and authentic reflection of customers' experiences with the products. We are, therefore, committed to maintaining the integrity and trustworthiness of Reviews on our website ("Site").
This Product Review Policy gives you an overview of the steps we take to prevent and remove fake and misleading Reviews, ensuring that any Review published by us is accurate and genuine, and set out the terms governing your conduct associated with submitting a Review.
By accessing, browsing, using, registering on or contributing to the Site, apps and any other area of the Site where you can submit a Review you confirm that you have read, understood and agree to the following terms.
References to "we," "us," and "our" throughout this document are intended to refer to your respective counterparty in the Bitrefill Group (pursuant and as defined in the Bitrefill's Terms and Conditions available at https://www.bitrefill.com/terms/, "Terms and Conditions"), including its affiliates, representatives, and authorized personnel, as the context requires. References to "you" or "your" means the person which submits a Review through Bitrefill's review function.
1. SUBMITTING A REVIEW
1.1. In submitting a Review, you declare that:
1.1.1. You are at least 18 years old;
1.1.2. You are the sole author and owner of the Intellectual Property Rights in the content of your Review;
1.1.3. All content posted by you in your Review is accurate and complies with this Product Review Policy; and
1.1.4. Any use of the content posted by you on your Review does not violate any Intellectual Property Rights.
1.2. Your accept and acknowledge that Bitrefill's review function cannot be used as a means to disseminate content that violates morality, public order, the rights of Bitrefill or any third party, or any applicable laws and regulations.
1.3. In submitting a Review, you further agree that you may not include in it content:
1.3.1. That is not in language that is not supported on the Site;
1.3.2. That is known by you to be false, inaccurate or misleading;
1.3.3. That infringes any Intellectual Property Rights;
1.3.4. That violates any law, statute, ordinance or regulation;
1.3.5. That is, or may reasonably be considered to be slanderous, abusive, obscene defamatory, libelous, hateful, racially or religiously biased or offensive, unlawfully threatening or unlawfully harassing to any individual, group, partnership or corporation, or that mention illegal activities in any form;
1.3.6. That includes any reference to (or depiction of) violence or pornography, or that would in any way undermine respect for persons or their dignity, the equal rights of women and men, or the protection of minors;
1.3.7. That includes propaganda, prospecting, or soliciting, whether for professional, commercial or political purposes, or any advertising messages, spam or references to other products, commercial offers or websites;
1.3.8. That is abusive, namely that includes systematic and non-objective criticism, as well as comments of malicious nature;
1.3.9. For which you were compensated or granted any consideration by any unapproved third party;
1.3.10. That includes any information that references other websites, addresses, email addresses, contact information or phone numbers; and
1.3.11. That contains any computer viruses, worms or other potentially damaging computer programs or files.
1.4. Only customers who have successfully purchased products from us are able to submit a Review. If your order was unsuccessful or cancelled, you cannot submit a Review.
1.5. You acknowledge that you, not Bitrefill, are responsible for the contents of your Review. None of the content that you submit shall be subject to any obligation of confidence on the part of Bitrefill, its agents, subsidiaries, affiliates, partners or third-party service providers and their respective directors, officers and employees.
2. MODERATING A REVIEW
2.1. Every Review is moderated by Bitrefill pursuant to this Product Review Policy before it is published on the Site.
2.2. Bitrefill uses technical and human validation processing steps to moderate Reviews. It can take up to 72 hours for your review to go through the moderation process.
2.3. Once submitted, the review cannot be modified by you. If you wish to modify your review, you must contact Bitrefill's Customer Support at support@bitrefill.com.
2.4. Bitrefill reserves the right to delete at any time any Review that does not comply with this Product Review Policy or the Terms and Conditions.
2.5. Reviews are not hidden, suppressed, edited, or deleted unless deemed or suspected to be in breach of this Product Review Policy.
2.6. Suspicious Reviews that have been reported to us, or discovered during an inspection, will be investigated in a thorough and timely manner by Bitrefill. Reviews that do not comply with this Product Review Policy will be taken down.
2.7. Bitrefill reserves the right to change, condense or delete any content on the Site that Bitrefill deems, in its sole discretion, to violate these this Product Review Policy, any applicable law or the rights of a third party. Bitrefill does not guarantee that you will have any recourse through Bitrefill to edit or delete any content you have submitted.
3. CONSEQUENCE FOR VIOLATIONS
3.1. If your Review does not comply with the this Product Review Policy, or if we find that you have engaged in any fraudulent, or other non-compliant activity, we reserve the right to:
3.1.1. Remove your Reviews;
3.1.2. Not publish your Review and prevent you from submitting a subsequent Review for the same product;
3.1.3. Limit your ability to submit Reviews; and/or
3.1.4. Suspend or terminate your account.
3.2. You agree to indemnify and hold Bitrefill (and its officers, directors, agents, subsidiaries, joint ventures, employees and third-party service providers) harmless from all claims, demands, and damages (actual and consequential) of every kind and nature, known and unknown, including reasonable attorneys' fees, arising out of your submission of a Review that is in violation of this Product Review Policy, any applicable law or the rights of a third party.
3.3. If you frequently submit Reviews that is in violation of this Product Review Policy, any applicable law or the rights of a third party, your right to submit Reviews may be temporarily or permanently disabled.
4. INTELLECTUAL PROPERTY
4.1. In this Product Review Policy, "Intellectual Property Rights" means all rights, title and interest to one's own intellectual property rights, including but not limited to any right, title or interest in any and all copyright, trademarks, patents, inventions, know-how, trade names and registered and industrial designs, including any applications, renewals or registrations.
4.2. Bitrefill holds all Intellectual Property Rights to both the structure and content of the review function (including, but not limited to, text, logos, images, illustrations, photographs, videos, graphic or sound elements, music, icons, page layouts, graphic guidelines, software, databases, etc.) or has regularly acquired the rights/authorizations to use them. All trademarks and/or logos reproduced therein are the exclusive property of either Bitrefill, or an affiliate, or their service providers, partners or suppliers.
4.3. Any use of these elements, in any manner and for any purpose whatsoever, other than the use strictly necessary for the dissemination of your Review, is prohibited without the express, written and prior authorization of Bitrefill or the holder of the Intellectual Property Rights concerned.
4.4. You will refrain from infringing the any Intellectual Property Rights.
4.5. Bitrefill reserves the right to take any measures or sanctions, as appropriate or necessary, in case of any unauthorized or abusive use of Intellectual Property Rights by you.
4.6. In respect of any content that you submit, you grant Bitrefill a perpetual, irrevocable, royalty-free, transferable right and license to use, copy, modify, delete in its entirety, adapt, publish, translate, create derivative works from, sell, distribute and/or incorporate such content into any form, medium or technology throughout the world without compensation to you.
5. PERSONAL DATA
5.1. In connection with the review function, Bitrefill may collect your personal data.
5.2. Only the fields in the data collection form followed by an asterisk are mandatory in order to be submit a review on the Site.
5.3. You are informed that all or some of Your personal data collected in this manner by Bitrefill can be used by Bitrefill, and as relevant by its service providers, in order to publish Your product review on any media channels used by Bitrefill.
5.4. To learn about Bitrefill's practices regarding the collection and use of Your personal data, the exercise of any of Your rights of access, rectification and deletion, please refer to Bitrefill's Privacy Policy available at https://www.bitrefill.com/privacy/.
6. HOW TO REPORT VIOLATIONS
6.1. If case you become aware of a Review that violates any of this Product Review Policy, any applicable laws or any rights of a third party, please email support@bitrefill.com, and tell us why you think it is a violation.
6.2. If someone offers you compensation for creating, editing, or posting content that violates our this Product Review Policy, any applicable laws or any rights of a third party, forward the offer to support@bitrefill.com.
